BY ACCESSING THE SITE, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS (TERMS). YOU CAN PRINT OFF THESE TERMS, OR STORE THEM IN YOUR COMPUTER, FOR FUTURE REFERENCE. IF YOU DO NOT WISH TO ACCEPT THESE TERMS, PLEASE EXIT THE SITE.
The Site is provided by Women in Film & Television (UK) Limited (we/us/WFTV), a company incorporated in England and Wales under company number 2488927, whose registered office is at 30 City Road, London, EC1Y 2AB and whose VAT Registration No. is VAT No: 282 8282 82.
We are a private, not for profit organisation set up to protect and enhance the status, interests and diversity of women working at all levels in both film, television and digital media industries. The Site provides information regarding WFTV and its activities (the Service). We also offer the opportunity to become a member of WFTV, which will allow you to access information not available to non-members, including the Restricted Materials referred to and defined below (the Membership Service).
3.1 Although we aim to offer you the best service possible, we make no promise that the services at the Site will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Site you should report it to info@wftv.org.uk and we will attempt to correct the fault as soon as we reasonably can.
3.2 Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
4.1 These Terms govern your use of the Website Materials.
4.2 Some website materials including the Application Form are freely accessible to the public (the Public Materials). Other website materials are reserved to those individuals who have been admitted as a Member (the Restricted Materials). The Public Materials and the Restricted Materials are together referred to as the Website Materials.
4.3 You agree not to access the Restricted Materials without having been admitted as a Member and without having paid the subscriber fee, where relevant.
5.1 The current price of a subscription shall be as shown on the Join page on the Site and if payable, the following conditions shall apply:
5.1.1 Our prices are inclusive of any applicable VAT.
5.1.2 Any details given in relation to exchange rates are approximate only and may vary from time to time.
5.1.3 You shall pay all sums due to us under these Terms by the means of the payment specified on the Site and without any set-off, deduction, counterclaim and/or any other withholding of monies. Any applicable banking charges on such payments shall be borne by us.
5.1.4 Payment shall not be deemed to be made until your credit or debit card has been authorised in respect of the full amount outstanding.
5.1.5 Cancellation and/or termination of these Terms by you or us at any time for any reason, unless we are in breach of these Terms or the Membership Service is discontinued, will not entitle you to a refund of monies paid.
6.1 When you register in respect of the Membership Service you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting info@wftv.org.uk immediately.
6.2 If we have reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account.
7.1 Once you have paid for access to the Membership Service, we make the Membership Service available to you.
7.2 Your access to the Service and/or the Membership Service may be terminated by written notice if you are in material breach of these Terms and the breach is not remedied within the period of 14 days after written notice of the breach has been given to you. If we reasonably believe your breach of these Terms affects our lawful operation of the Service or third party customers we may suspend your access to the Service and/or the Membership Service at any time.
7.3 You may terminate the Membership Service and receive a pro-rata refund of any current subscription fee you have paid if the Membership Service is discontinued or if we are in material breach of these Terms and the breach is not remedied within the period of 14 days after written notice of the breach has been given to us.
7.4 You can cancel your registration in respect of the Membership Service at any time by informing us in writing at info@wftv.org.uk. If you do so, you must stop using the Site.
7.5 The suspension or cancellation of your registration in respect of the Membership Service and your right to use the Site shall not affect either partys statutory rights or liabilities.
The copyright, database rights, and other intellectual property rights (IPR) in the Website Materials displayed on or via this Site (including text, graphics, and audio and visual content) are owned by or licensed to us, or the owners of third party websites. This IPR is protected by the laws of England, International Treaties and all other applicable copyright and intellectual property laws. You agree to respect our IPR and the IPR of third parties.
The display of any trade names or trade marks within the Website Materials does not imply that any licence has been granted to any third party in respect of the same. All other product or company names, devices, logos, icons, graphics or designs referred in the Website Materials are the trade marks of the respective owners and are exhibited only in such a manner as is intended to be for the benefit of such trade mark owners. We intend no infringement of such trade marks. The appearance or absence of products, services, companies, organisations, home pages or other websites on this Site does not imply any endorsement or non-endorsement thereof by us.
10.1 You are authorised to download any number of copies of the Public Materials for your own personal, non-commercial use, and may make such copies available to third parties provided that (a) you acknowledge the source (b) you do not remove or amend any trade mark, copyright or other ownership notice, and (c) each recipient agrees to these Terms.
10.2 The following activities are prohibited without our express prior written permission:
10.2.1 the deployment within our Site of any spider, robot, web crawler or other automated query program; and
10.2.2 the re-use and/or aggregation of a substantial or significant part of the Website Materials in the provision of a commercial service.
10.3 The copying and use of third party website materials accessed via this Site is governed by the terms of use applicable to the third party site which you have accessed.
11.1 To the extent that portions of this Site (such as chat rooms, profiles or bulletin boards) provide users an opportunity to post and exchange information, ideas and opinions (Postings), please note that we do not screen, edit, or review postings prior to their appearance on this Site, and Postings do not necessarily reflect our views. To the fullest extent permitted by applicable laws, we exclude all responsibility and liability for the Postings or for any losses or expenses resulting from their use and/or appearance on this Site.
11.2 You hereby represent and warrant that you have all necessary rights in and to all Postings you provide and all material they contain and that such Postings shall not infringe any ownership or other rights of third parties, shall not contain any viruses or other contaminating or destructive devices or features. Material contained in Postings shall not be defamatory, indecent, offensive, tortious, or otherwise unlawful. Postings shall not be used to carry out or solicit any unlawful activity.
11.3 All information (including but not limited to ideas, suggestions, concepts and graphics) submitted to us through this Site will become our exclusive property. Except as provided by the Data Protection Act 1998, we shall not be subject to any obligation of confidentiality and will be free to use the information for any purpose.
12.1 The Public Materials are provided free of charge on an as is basis. To the fullest extent permitted by applicable law we exclude all warranties, representations or understandings whatsoever, express or implied, including but not limited to any warranty of satisfactory quality, merchantability, fitness for a particular purpose, freedom from computer viruses, and non-infringement of third parties' rights in respect of the Website Materials. We reserve the right at any time and without notice to change, amend or otherwise vary the Website Materials.
12.2 We hereby exclude liability:
12.2.1 for any claims, loss, demands or damages of any kind whatsoever with respect to the Service and the Membership Service, for loss of profit or other economic loss, or any indirect, incidental or consequential loss or damages, whether or not we have been notified of the possibility of such loss; and
12.2.2 for any errors in or omissions from information, materials and functions included in the Website Materials.
12.3 Nothing in these Terms affects our liability (if any) for death or personal injury, or fraudulent misrepresentation.
12.4 Your rights as a consumer (if any) are not affected by these Terms.
You agree to indemnify us against all claims, charges, demands, damages, liabilities, losses and expenses of whatever nature and howsoever arising (including but not limited to any legal or other professional fees and the cost of defending or prosecuting any claim and any loss of profit, goodwill and any other direct or consequential loss) incurred or suffered by us directly or indirectly by reason of any act or omission which you commit in breach of these Terms and the obligations and warranties contained in them.
14.1 By using hypertext or other computer links you will be able to access other website pages on the Internet which are not part of our web pages. We cannot vet, modify or edit nor do we assume any liability for the contents of other websites or home pages that are linked to our Site.
14.2 We shall have no liability in respect of material hyper-linked to our Site which may be misleading, inaccurate, defamatory, threatening or obscene or otherwise not in accordance with applicable regulations.
14.3 The provision by us of a link to another website does not constitute any authorisation to access materials held at that location, nor is it evidence of any endorsement by us of the material held there.
15.1 By agreeing to these Terms you agree to the terms of our Privacy Policy.

15.3 In accordance with applicable UK data protection legislation we reserve the right to charge a fee for providing such information.
16.1 If you have any questions or complaints regarding the Site or these Terms, concerning these Terms please write to us at the postal or e-mail address specified above.
16.2 All rights not expressly granted in these Terms are expressly reserved.
16.3 These Terms constitute the entire agreement between you and us.
16.4 If any of the provisions of these Terms is held by a court of law to be illegal or otherwise unenforceable by the laws of any state or country, the affected provision shall be deemed to be deleted from these Terms and the remainder of these Terms shall remain in full force and effect.
16.5 Any failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.6 We reserve the right to change any of these Terms from time to time without prior notice, such changes becoming effective immediately upon posting to the Site and by continuing to use the Site, you will be deemed to accept any such changes.
You irrevocably agree that the courts of England shall have exclusive jurisdiction to resolve any dispute or claim of whatever nature arising out of or relating to this Site, and that the laws of England shall govern such dispute or claim. However, we retain the right to bring legal proceedings in any jurisdiction where we believe that infringement of our IPR or breach of these Terms is taking place or originating. You are responsible for compliance with any applicable laws of the country from which you are accessing this Site. We operate this Site from England and make no representation that the information contained herein is appropriate or available for use in other locations outside England.
